Choice of school

In many cases, the choice of school is straightforward but what happens when parents who are divorced can’t agree on a choice of school?

Where parents both have parental responsibility for their child, major decisions relating to the child, including choice of school, need to be made jointly. If agreement can’t be reached, mediation may help, but if that is also unsuccessful, an application to the court for a specific issue order will be required.

The court will make a decision taking into account what is in the child’s best interests. If you need to make such an application, you will need to gather as much evidence as possible to support the school of your choice and to show the court why that is in your child’s best interests. All of this can take some time to resolve so make sure you consider your application in plenty of time for any school or local authority deadlines.
